Patent Infringement, Juul Labs Asks ITC to Block Imports and Sales of NJOY Ace Products

Vapeboss – The global vape industry is currently in fierce competition. Several vape manufacturers are also competing in product development innovation for what is known as an alternative to conventional cigarettes.

Last Friday, June 30, 2023, Juul Labs reportedly filed a complaint with the International Trade Commission (ITC) and a lawsuit in federal district court, both alleging Juul's patent infringement by the NJOY Ace pod vape. The complaint named NJOY and its new parent company, Altria Group.

The exact patent infringement allegations are unknown. In a summary of the lawsuit filed in the U.S. District Court for the District of Arizona, Law.com states that Juul Labs and VMR Products (a Juul subsidiary) are suing for infringement of “five patents related to ‘JUULpod’ cartridges.” The ITC filing is less specific, only noting that Juul Labs has requested an investigation “regarding certain vaporizer devices, cartridges used therewith, and components thereof.”

Juul Labs also asked the U.S. International Trade Commission (ITC) to block the sale and import of NJOY Ace vapor devices, claiming that the product infringes several Juul patents. It has also filed a complaint against NJOY in the U.S. District Court for the District of Arizona.

Juul Labs Chief Legal Officer Tyler Mace stated, “Our technology, designed internally in the U.S. and protected by our robust patent portfolio, has been the most effective product development in transitioning adult smokers from combustible cigarettes and providing a solution for over 2 million adult smokers in this country. Innovation is critical in this regard to advance tobacco harm reduction.”

“When others infringe upon our technology, we have no choice but to protect our intellectual property rights,” he added.

According to reports, Juul Labs has filed three patent and trademark complaints with the ITC, but the target of these actions has been much smaller companies that make copies of Juul products or sell "Juul-compatible" pods. NJOY, with Altria's backing, may prove to be a tougher legal opponent.
