Vapeboss – Last Tuesday (11/7), the government officially ratified the Health Bill into law during the DPR Plenary Session of the 5th session period of the 2022-2023 legislative year. Based on the latest draft Health Law, regulations for vapes or electronic cigarettes are equated with those for conventional cigarettes.

This is stated in the latest Law on Health, which stipulates that electronic cigarettes are included in solid and liquid tobacco products, which are essentially addictive substances.

"Addictive substances include all tobacco products whose use can cause harm to oneself and/or society," states Article 149 paragraph (2).

The tobacco products referred to include cigarettes, cigars, leaf cigarettes, sliced tobacco, solid tobacco, liquid tobacco, and other processed tobacco products.

In the explanatory section of the Health Law, electronic cigarettes are included in products that contain tobacco or do not contain tobacco, whether in the form of cigarettes or other forms.

"Solid and liquid tobacco, among others, can be used for electronic cigarettes and shisha," reads the explanation for Article 149 paragraph (3) letter e.

"What is meant by 'electronic cigarettes' are tobacco products in liquid, solid, or other forms derived from the processing of tobacco leaves made by extraction or other methods in accordance with technological developments and consumer preferences, regardless of substitute or auxiliary materials in their manufacture, provided to end consumers in retail packaging and consumed by heating using an electronic heating device and then inhaled," the explanation further states.

The latest Health Law also regulates the obligation for parties that produce and import tobacco products or electronic cigarettes to include health warnings.

"Health warnings as referred to in the paragraph shall be in the form of text accompanied by images," reads Article 150 paragraph (2).
