Jakarta Regional Government Implements Smoke-Free Zones, Vaping Carelessly Can Result in a IDR 250,000 Fine!

The DKI Jakarta Regional Government has drafted a Regional Regulation on Non-Smoking Areas, which will apply in several areas of Jakarta. Both smoking and vaping carelessly will be subject to a fine of Rp 250,000.

"The harmonization of this Draft Regional Regulation on Non-Smoking Areas has been completed by meeting 10 dimensions established in the drafting of the Regional Regulation," said the Head of the DKI Jakarta Law and Human Rights Division, Ronald Lumbuun.

According to Article 1, paragraph 6, which states that electronic products or vapes are equated with cigarettes, it reads:

A cigarette is a processed tobacco product wrapped, including cigars or other forms produced from the plants Nicotiana Tabacum, Nicotiana Rustica, and other species or their derivatives or synthetics, including shisha, electronic cigarettes, vapes, heated tobacco products, evaporated products, and/or other forms containing nicotine and tar with or without additives.

Ronald explained that the sanction for KTR violators is an administrative fine of Rp 250,000 or social work, which will be imposed directly on the spot.

"Anyone who smokes in a Non-Smoking Area will be subject to administrative sanctions in the form of a fine of Rp 250,000 and/or social work sanctions that can be carried out directly on the spot," said Ronald.

Not only from Article 1, Ronald said that Article 6 also explains that the public is not allowed to provide special smoking areas or spaces in areas where KTR applies, and if they wish to smoke, they can do so outside the KTR area.

"Everyone is prohibited from providing special smoking rooms or areas in Non-Smoking Areas. Smoking can be done outside Non-Smoking Areas," reads Article 6.

Meanwhile, the places where KTR applies are as follows:

  1. Health service facilities
  2. Teaching and learning places
  3. Children's playgrounds
  4. Places of worship
  5. Sports facilities
  6. Public transportation
  7. Workplaces
  8. Public places
  9. Other specific places or open spaces utilized and accessible to the general public that are designated as Non-Smoking Areas.
