SB 0512, The Preventing Youth Vaping Act, which went into effect in Illinois, considers any electronic device that delivers nicotine to be adulterated if it has not been granted a Premarket Tobacco Product Application (PMTA) by the FDA.
However, since this state's adulteration provision only applies to devices that require PMTA authorization, it will not apply to products that are not considered "tobacco products" under the federal Food, Drug, and Cosmetic Act, such as products using synthetic (tobacco-free) nicotine or CBD. Any violator of this new state law will be deemed guilty of a Class 4 felony, which carries a sentence of 1-3 years in prison and a fine of up to $25,000 if convicted.
Online sales ban in Oregon
Meanwhile, Oregon's HB 2261 prohibits the delivery of "inhalant delivery systems," defined as devices that can be used to deliver nicotine in vapor or aerosol form to a person inhaling or its components, to members of the public other than distributors or retailers. In other words, this act prohibits direct-to-consumer sales, including online sales of e-cigarettes.
The measure was initially proposed by Ellen Rosenblum, Oregon Attorney General and head of the state's Department of Justice, as a means to combat youth vaping and offer the state's criminal justice system tools to combat counterfeiting and illicit sales.
“There is no effective way to verify age or stop minors from purchasing these products over the internet. In Oregon, you cannot buy cigarettes online, and there is no good reason to be able to buy vape products online either,” she said earlier this year in a press statement.
No more loopholes for synthetic nicotine
Meanwhile, New Jersey Congresswoman Mikie Sherrill recently introduced the Clarifying Authority Over Nicotine Act of 2021, a bipartisan bill that gives the FDA the authority to regulate synthetic nicotine products, in the same way it regulates nicotine products made or derived from tobacco.
This means that Illinois' SB 0512 could soon be expanded to include synthetic nicotine. As it stands, the Federal Food, Drug, and Cosmetic Act (FDCA) defines "tobacco product" as "any product made or derived from tobacco that is intended for human consumption, including any component, part, or accessory of a tobacco product." However, the FDA may choose to regulate synthetic nicotine as either a "component" of a tobacco product or as a "drug."
