No-Smoking Areas Apply in Jogja, What About Vapes?

The plants as previously written in the general provisions also have other species and synthetic types that contain at least nicotine, tar, addictive or carcinogenic substances with or without additional ingredients.

According to Suwarna, if viewed from the general provisions in this regional regulation and if vape or e-cigarettes have the same characteristics, then vape can be classified as the same as cigarettes.

"If we look at this, then if vape also contains elements that meet the definition of cigarettes in the general provisions of this regional regulation," said Suwarna.

Need for Further Study

However, Suwarna also added that in-depth study is needed to determine whether vape or e-cigarettes meet the elements and characteristics in the Regional Regulation.

"If the elements of vape are then the same as those in this provision about cigarettes, then it falls within. But if not, then it does not fall within the scope of enforcement of Regional Regulation Number 2 of 2017," he concluded.

Actually, the sanctions for this KTR policy are not yet fully effective. Although the maximum fine stipulated in the regional regulation is 7.5 million for offenders, the Yogyakarta City Government is still pursuing persuasive efforts. Given that the pandemic is still ongoing, the Yogyakarta City Government is reluctant to impose fines as long as the pandemic situation persists.
