1.4 Tons of Vapes Seized Due to Many Vape Sellers Not Complying With Regulations

Vapeboss – The increasing use of e-cigarettes is almost entirely driven by a wave of cheap disposable vapes imported from China, according to sales data obtained by The Associated Press news agency. Most are sold in various flavors such as food, drinks, and fruit that appeal to teenagers. The number of e-cigarette devices sold in America has nearly tripled to over 9,000, despite the US Food and Drug Administration (FDA)'s three-year effort to eradicate flavored cigarettes typically favored by children.

According to a report from Inter Scientific, an agency offering analytical and regulatory services, many vape retailers are not following the rules. An investigation by the firm examined brands sold in stores in Birmingham, Dudley, Hertfordshire, Liverpool, Newcastle, Staffordshire, and Wales, and found that many did not comply with required standards. Tests conducted found that some vapes claimed to be nicotine-free actually contained the same levels of addictive substances as regular vapes.

All these vapes are technically illegal but continue to flow into US ports. This trend underscores the FDA's inability to control the chaotic vaping market, previously dominated by Juul and other reusable e-cigarettes.

Not only that, 73% of the products examined were above the legal capacity of 2ml, while more than 40% of the tested products were filled with 5ml or more. In the UK alone, more than 1.4 tons of illegal vapes were seized in the last six months of 2022. In fact, Health Minister Neil O'Brien recently voiced his concerns about the increasing use of disposable vapes. To address this issue, £3 million has been allocated. The funds include experimental purchases by trade standards officers in an effort to catch any retailers selling vape products to individuals under 18 years old.

The plan was announced at a recent Policy Exchange, where O'Brien stated that "illegal vape enforcement teams" would conduct these checks in all vape shops across the UK. These teams will also issue guidance on how to ensure these laws are complied with by everyone, as well as seize any illegal products found.

All tobacco products, e-cigarettes, and vape products must comply with strict tobacco control laws, including restrictions on nicotine content and tank size. Some seized products had tank sizes up to seven times the legal limit and incorrect labeling, with devices lacking information including health warnings, batch details, and hazard warnings.

Vaping devices must also display the contact details of the manufacturer or importer in case of safety issues. A large number of seized disposable vapes are not allowed for sale in the UK. This comes as a result of consumer concerns regarding the sale of vaping devices to children. During a test purchase conducted by Trading Standards in March of this year at 32 retailers, 44% of retailers sold vaping devices to minors.
